Financial claims: organize the file before choosing a procedure

Preparation information for discussing financial claims. Acceptance and scope of any assignment must be confirmed separately.

Overview

Understanding a claim begins with more than its amount: why it is said to be due, who is involved, what has been performed or paid, and what the other party disputes. Organizing those details makes it possible to discuss the legal question rather than simply calling it a debt.

This is general preparation information. It does not establish entitlement, evidential sufficiency or a procedure suitable for every case. It promises neither recovery nor its timing. Any existing notice or deadline requires assessment separately from this page.

Matters a file may involve

Sums arising from dealings or an agreement: Prepare the basis and calculation of the amount, payment terms, earlier payments and disputed points. Do not assume that a figure in a statement prepared by one party alone establishes entitlement.

Cheques and promissory notes: Preserve the relevant documents, their condition and dates, and associated correspondence, and request legal assessment before choosing a procedure. This page does not say that every document allows direct enforcement or creates criminal liability. Confirm separately whether the office accepts this particular type of file.

How is a claim assessed?

Organize three groups: the basis of the claim, the calculation, and prior communications or proceedings. Write a chronology and identify disputed points. Include earlier payments, later agreements and objections that may affect assessment.

Legal review considers the proper party to make or answer a claim, facts needing proof, documents and existing proceedings before possible options are discussed. This describes assessment, not a compulsory litigation timetable. Negotiation, proceedings and enforcement do not follow the same sequence in every file.

Where a judgment or enforcement file exists

Prepare the judgment, decisions, notices, file number and earlier payments, and identify the question you want to discuss. This page does not determine enforceability, attachment or objection procedures or their deadlines.

Useful preparation documents

Depending on relevance and availability, prepare copies of agreements, invoices, receipts, transfers, correspondence and commercial documents, with a calculation showing the original amount, payments and the balance as you calculate it. Include existing or earlier case papers and identify whether you hold originals or copies.

These are preparation examples, not an official filing list or assessment of evidential value. Agree an exchange method and the documents needed before sending sensitive material or originals.
